Legislative victories for Texas real estate
The 85th legislative session ended May 29, and even though property tax reforms weren’t ultimately passed, Texas REALTORS® had a hugely successful legislative session on behalf of Texas real estate consumers.

Here’s a rundown of some of these TAR-supported victories:

  • Voters in the November election will have the chance to update the home-equity lending provisions in the Texas Constitution to establish more favorable lending conditions for homeowners.
  • Gov. Abbott signed a bill that will give real estate buyers more disclosure about properties near military installations.
  • Gov. Abbott signed a bill that creates a statewide standard for transportation network companies (TNCs) to ensure Texans have access to alternative transportation options across the state.
  • A bill to prohibit cities from charging linkage fees on all new residential and commercial construction was signed into law last week.

Texas REALTORS® also successfully defeated legislation detrimental to the state’s Texas real estate industry, including legislation that would have changed the state’s current title insurance marketplace, which provides consistent rates applied evenly to all real estate buyers. The proposed legislation would have had several negative effects, including increased cost of title insurance.

Bills by the number this legislative session:

  • 7,051 bills were filed this session—and TAR read every single one to ensure the interests of Texas REALTORS® and real estate consumers were protected.
    • By comparison, 6,715 bills were filed last session.
  • TAR tracked 2,767 bills (39%) that had potential to directly or indirectly affect Texas real estate.
    • By comparison, last session TAR tracked 2,201 bills (33%).
  • 1,283 bills (18%) were enrolled/sent to the governor to be signed into law.
    • The deadline for the governor to veto bills is June 18.
    • By comparison, last session 1,424 bills (21%) were enrolled/sent to the governor.
  • 413 bills (6%) were tracked by TAR and enrolled/sent to the governor.
